Driveway Permit Process:
Step 1 - Fill out the Driveway Permit
Step 2- Send in or drop off the Drive Way Permit at the Town Hall.
Step 3 - Once we receive your completed permit, it is given Designated Town Official. Within approximately 24-48 hours, Tom will travel to your home to look at the property/driveway.
Step 4 - When Designated Town Official gives the “okay, “ the resident is responsible to come to the town hall and/or send in the Permit Charges that will include a Driveway Bond (refundable after the job is completed, the procedures are followed correctly, and the final driveway is approved) and/or other fees.
Driveway Bond - $1,000 (refundable)
The Driveway Bond is refundable upon completion of the following: a) notice to the Town Clerk that the Project is Finished b) Inspection by Designated Town Official c) Town Board Approval
Utility-Right-of-Way - $100 (non-refundable) - For New Driveways
Utility-Boring in Right-of-Way - $300 (non-refundable) - For Re-pavement of Driveway
Step 5 - Once the job is complete, the resident should contact the Town Clerk at the Town Hall at 262-728-3471 or [email protected], alerting us that the job is complete.
Step 6 - Designated Town Official will travel out to your property and inspect the driveway.
Step 7 - If all is good, our Designated Town Official will contact our Treasurer, who will reimburse you for your $1,000 bond. A check will be sent to you in the mail.

DAMAGES AND LOSS OF BOND: Any damage which is the result of nay repair, maintenance, or construction on roadways or road right of way, driveways in the Town of Delavan, shall be the responsibility of said party causing damage. The said party will have fifteen (15) days to repair damage or said party will pay the costs of damage to the Town of Delavan for the damage.
ROADWAY EXCAVATIONS: Replace with compacted suitable materials within twelve (12) inches of surface, road gravel or equivalent compacted to surface (9” gravel, 3” asphalt). Note: Cold patch may be used until weather permits.
DRIVEWAY GUIDELINES TO BE FOLLOWED:
1) Proper size, length, and pitch of culvert with end walls.
2) Culvert to be covered with 2” to 3” base stone.
3) Surface gravel ½” to ¾” gravel.
4) All disturbed areas to be restored with proper grading, seed, or sod when required, erosion control, (Straw or equivalent)
5) No rocks, washouts, debris, redi-mix materials.
6) No plantings (bushes or flowers, etc.), rocks, boulders, structures, fences, etc. within right of way. A rural mail box is the ONLY item allowed to be placed within right of way.
7) Town of Delavan is not responsible for any damage to mailbox.

According to state statute 125.23(2) and 125.68(2) regardless of what the expiration date says on your online Responsible Beverage Server Training Certificate, if your Town of Delavan (ie: Municipal) Operator License Application is renewed on time every two years (ie: TOD application received in our office, on or before Thursday, April 28, every two years) then an operator/server is NOT required to re-take the online Responsible Beverage Server Test.
Essentially, if you continually renew your operator’s licenses every two years by the end of April 28th), you will never have to pay or take that online course again. However, if an operator license laps and is not renewed every two years (on time), then an operator, would have to pay for, re-take and pass the online Beverage Server Training Certificate again before receiving their Regular Operator/Server License from the Town of Delavan.
So, get your operator/server renewal applications in by April 28th, preferably sooner, so you can spend time serving your customers, rather than spending four hours on the computer taking an extremely riveting (pun intended) test. The following are the Steps for Becoming an Official Short Term Rental Owner in the Town of Delavan.
- Register online for a State of Wisconsin seller's permit at tap.revenue.wi.gov/btr. Click on the previous link to complete that process.
- Complete the Tourist Rooming House License Application (Department of Agriculture - DOA)
- One Time Fee $300
- Annual Fee $110
- To obtain a Tourist Rooming House License through DATCP, call (608) 224-4923 or email their licensing specialists.
- Complete the Walworth County Short Term Rental Application - $200 (Renewal) $500 (New)
- Complete the Town of Delavan Short Term Licensing Application - $100
- Complete the Town of Delavan Room Tax Permit - $10
- Complete the Town of Delavan General Business Registration Application: $25
- Complete the Town of Delavan Business Directory Application
- Make Payment to the Town of Delavan for the appropriate Short Term Rental/Room Tax Fees ($100, $25, $10).
- Before the Town of Delavan can approve your Town of Delavan Room Short Term Rental License you are required to show proof of the following:
- State of Wisconsin Seller's Permit License
- Tourist Rooming House License
- Walworth County Short Term Rental License
- Before the Town of Delavan can approve your Town of Delavan Room Short Term Rental License you are required to show proof of the following:
- Pay your quarterly Room Taxes, using our Room Tax Calculation Form, to the Town of Delavan
- If, you use VRBO or another entity that pays the Municipality Room Tax, you must still report your individual room tax information to the Town of Delavan each quarter. Please contact that entity for that report.
Near the end of each quarter, Short Term Rental owners should contact VRBO, airBnB, etc, unless you are tracking everything on your own, and get a statement/numbers from them, showing what you paid. You still need to report this income to the Town of Delavan (see explanation above). So the easiest way to do that is to just use the Room Tax Calculation Form and send it to the Town of Delavan. You wouldn’t need to send the money to the Town of Delavan, because it was already collected by VRBO.

Under 2017 Wisconsin Act 59, a lodging marketplace providing short-term residential lodging must register with the Wisconsin Department of Revenue (DOR) for a license to collect taxes imposed by the state related to a short-term rental and to collect room taxes imposed by a Wisconsin municipality.
The application for the license, Form 231, Lodging Marketplace Application, is available on our website at revenue.wi.gov (search "Form 231"). See page two of the application for definitions.
If the lodging marketplace is engaged in business in Wisconsin, it must also:
- Register for a seller's permit at tap.revenue.wi.gov/btr, if it does not already have one
- Contact each Wisconsin municipality in which it makes short-term rentals to determine if additional registration is required
- Collect Wisconsin sales and use taxes from the occupant and forward to DOR
- Collect applicable Wisconsin municipal room taxes from the occupant and forward to the municipality
- Notify the owner of the short-term rental that the taxes have been collected and forwarded.
- A list of lodging marketplaces licensed by DOR will be posted on our website.
Short Term Rental Room Tax - Doesn't the VRBO collect the Town of Delavan Room TAX?
VRBO and "some" other entities now collect and submit for the State, County and the Town of Delavan.
However, Short Term Rental owners still need to report your information to the Town of Delavan because VRBO and "some" other entities do not send us individual statements from each homeowner. They only give us a “lump sum” statement of all of the short term rental owners. So, the Town of Delavan still needs an individual report from you, which you can get from VBRO. Highlight from our Short Term Room Tax Ordinance 397
Each license holder is obligated to complete, sign and file a quarterly room tax return and remit the applicable room tax to the Town as required by the provisions of section 3.10 of this code. Such quarterly room tax return must be signed by the license holder regardless of whether or not the license holder contracts with a third party such as VRBO, Home Away or Air BnB, or other market place provider to administer such rental or collect such tax
